Terms of Service

1. Acceptance of Terms

By accessing or using the services provided by Zakool AI Technologies Limited ("Zakool AI", "we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Services.

2. Services

Zakool AI provides AI-powered sales support for real estate developers, brokers, and related businesses. Services include conversational AI assistants, lead qualification, and related analytics, integrations, and tools.

3. Eligibility

You must be at least 18 years old and have the authority to enter into these Terms on behalf of your organization.

4. Customer Data & License

You retain all right, title, and interest in and to any data, content, or materials you provide to Zakool AI ("Customer Data"). You grant Zakool AI a non-exclusive, worldwide, royalty-free license to host, copy, process, transmit, and display Customer Data solely to provide and improve the Services. Zakool AI may generate Aggregated and De-identified Data that does not identify you or any individual, which it may use for analytics and service improvement.

5. Acceptable Use

• Do not use the Services in violation of applicable law.
• Do not send spam or unlawful content.
• Do not attempt unauthorized access to the Services.
• Do not copy, modify, or create derivative works of the Services.
• Do not perform security testing without prior written consent.

6. Third-Party Services & Subprocessors

The Services may integrate with third-party platforms such as WhatsApp, HubSpot, Salesforce, and OpenAI. We may engage subprocessors to deliver the Services and remain responsible for their performance. A current list of subprocessors is available upon request.

7. Security & Compliance

We implement industry-standard security measures, including encryption, access controls, and secure hosting environments, to protect Customer Data. We follow recognized security best practices and continuously review and update our controls.

8. Publicity

You agree that Zakool AI may identify your organization as a customer and use your name and logo in marketing materials, on our website, and in presentations, unless you provide written notice requesting otherwise.

9. Fees & Payment

Fees are as specified in your order or agreement. All fees are non-refundable unless otherwise stated. Payments are due in the currency and within the timeframe specified in your invoice.

10. Term & Termination

Either party may terminate these Terms for material breach if not cured within thirty (30) days after written notice. Upon termination, your right to use the Services will cease.

11. Limitation of Liability

To the maximum extent permitted by law, Zakool AI’s total liability arising out of or related to these Terms will not exceed the total fees paid by you in the twelve (12) months preceding the claim. Zakool AI will not be liable for any indirect, incidental, special, consequential, or punitive damages.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of the Dubai International Financial Centre (DIFC). The parties submit to the exclusive jurisdiction of the DIFC Courts.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be notified to you via email or through the Services before they take effect.
